Abstract

There is a conflict between the Islamic concept of punishment and the provisions of the Universal Declaration of Human Rights. The declaration talks about the respect and reverence of the human soul, while the standard of respect and reverence in Islam is "Taqwa". Islam teaches the principle that one who leads the society to destruction is not as worthy of respect as a useful citizen is worthy of praise. Whether the crime is small or large, individual or collective, murder or the perpetrators of other social crimes do not deserve respect like those people. While under this article it is said that the criminal, no matter how impeachable a crime he has committed, should not be punished in a way that humiliates him. It is not so, because if criminals and non-criminals are considered worthy of the same respect and respect, then how will crimes be prevented in the world? In this, Islam is not convinced of equal respect for the guilty and the innocent.
